1. Eligibility
The CAO App is intended solely for use by licensed orthodontists who are current members of the California Association of Orthodontists. By using this App, you confirm that you are a member in good standing of the CAO. Unauthorized access or use of the App is strictly prohibited.
2. Proprietary Data and Information
All data, information, and materials available through the App, including but not limited to proprietary resources, guidelines, research, and communications, are the exclusive property of the California Association of Orthodontists. This information is provided solely for the personal and professional use of CAO members and may not be distributed, copied, reproduced, or transmitted without prior written consent from the CAO.
3. License and Use Restrictions
The CAO grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for professional purposes related to orthodontic practice. You agree not to:
Copy, modify, distribute, or create derivative works from any content within the App.
Reverse-engineer, disassemble, or attempt to extract the source code of the App.
Use the App for any illegal or unauthorized purposes.
Share access to the App with individuals who are not members of the CAO.
4. App Updates and Changes
The CAO reserves the right to modify, update, or discontinue the App at any time, with or without notice. You agree that the CAO shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
5. User Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and ensuring that no unauthorized individuals access the App using your account. You agree to immediately notify the CAO of any unauthorized use or breach of security.
6. Data Privacy
The CAO respects your privacy. The App may collect, store, and use certain personal information to provide a better user experience and improve the functionality of the App. By using the App, you agree to the CAO’s Privacy Policy, which governs the collection and use of your personal data.
7. Disclaimers
The App and all information within it are provided “as is” without any warranties, express or implied. The CAO does not warrant that the App will be error-free, secure, or operate without interruption. The CAO disclaims all liability for any harm resulting from the use of the App, including but not limited to technical failures, data loss, or unauthorized access.
8. Limitation of Liability
To the fullest extent permitted by law, the CAO shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App, even if the CAO has been advised of the possibility of such damages.
9. Termination
The CAO reserves the right to terminate or suspend your access to the App at any time, with or without cause or notice, for violations of these Terms or any other reason.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from the use of the App shall be subject to the exclusive jurisdiction of the courts in California.
